Terms of service

The agreement between you and JEMFYRD when you use this site or place an order. We have kept it readable. Nothing in it removes the consumer rights your local law guarantees you.


9.1 Who can use the store

You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of the details you give us and, if you create an account, for keeping your password confidential and for activity under your account. Tell us promptly of any unauthorized use.


9.2 Orders and acceptance

Product listings are an invitation to treat, not an offer. Your order is an offer to buy; a contract forms only when we dispatch the piece (or confirm dispatch). We may decline or limit any order, and may correct pricing or description errors, as set out in Parts 3 and 4.


9.3 Product representation

We describe and photograph every piece as faithfully as we can. Measurements and weights are approximate. Colours and finishes may appear differently on different screens; this is a limitation of digital display, not a defect.


9.4 Intellectual property

The JEMFYRD and Dekulture names, marks, designs, photography, copy, the Provenance Document format and all site content are owned by us or our licensors and are protected by law. You may not copy, resell or exploit them without our written permission.


9.5 Your content (reviews, photos, UGC)

If you submit reviews, photographs or videos — including for features such as "Seen On Our Muses" — you confirm you have the right to do so and grant JEMFYRD a non-exclusive, worldwide, royalty-free licence to use, display and adapt that content for marketing and community purposes, with attribution where practical. You can ask us to stop using your content prospectively. We may moderate or remove content that is unlawful, misleading, offensive or off-topic, and we do not pay for content unless separately agreed in writing (influencer and affiliate terms in Part 11).


9.6 Handmade and natural-variation disclaimer

JEMFYRD pieces are hand-made and hand-finished. Variation in colour, tone, texture, weight, patina, oxidation and the placement of hand-set stones is inherent to this method and is part of each piece's character. Such variation, and the intended patina of oxidised collections, are not defects and are not grounds for a defective-item claim.


9.7 Prohibited conduct

  • Using the store unlawfully, fraudulently, or to infringe others' rights;
  • Interfering with the site's security or operation, scraping, or unauthorised automated access;
  • Reselling pieces as authorised JEMFYRD stock, or misrepresenting your relationship with us.


9.8 Third-party links

Our site may link to third-party sites we do not control. We are not responsible for their content, products or privacy practices; your use of them is at your own risk.


9.9 Force majeure

We are not liable for delay or failure caused by events beyond our reasonable control, including natural events, strikes, carrier or supplier failure, customs action, outages, or governmental measures.


9.10 Limitation of liability

Nothing in these terms excludes liability that cannot be excluded by law — including the mandatory consumer guarantees in your country (see Part 12) and liability for death or personal injury caused by our negligence or for fraud. Subject to that, our total liability arising from an order is limited to the amount you paid for the relevant piece, and we are not liable for indirect or consequential loss.


9.11 Indemnity

To the extent permitted by law, you agree to indemnify JEMFYRD against losses arising from your breach of these terms or your misuse of the store — this does not apply to ordinary consumer use of the site.


9.12 Governing law and disputes

These terms are governed by the laws of India, and the courts at Jaipur, Rajasthan have jurisdiction — except that, as a consumer, you keep the protection of the mandatory laws and the right to bring proceedings in the country where you live, where local law so provides. We will always try to resolve a concern informally first; EU consumers may also use the EU Online Dispute Resolution platform.


9.13 Changes to these terms

We may update these policies to reflect changes in our practices or the law. The version in force is the one published here, dated below. We will give reasonable notice of material changes — for example, by a site notice or email — and, where the law requires, obtain your consent.
